These terms & conditions constitutes the entire Agreement between You, Vodafone customer and Vodafone Albania Sh.A (Vodafone or We, Us, VFAL interchangeably) regarding the use of our online store (hereinafter referred to as the “Vodafone eShop”). Vodafone Albania Sh.A is a joint stock company established and existing under the laws of Albania, incorporated with the Tirana Court Decision No. 25766, dated 10 May 2001, having its registered office at: Autostrada Tirane- Durres, Rr. “Pavaresia”, Nr. 61, Kashar, Tirana, Albania, with Nipt: K11715005L.
These Terms & Conditions apply to purchases made through the Vodafone eShop, further to the General Terms and Conditions that apply to your use of the vodafone.al website. Please click here for full website general terms & conditions.
Vodafone eShop offers you the opportunity to use different services; to view, compare, and buy products online over the internet via Vodafone eShop section. Vodafone eShop provides You detailed information through its specific tabs.
This service is only available to you on the following conditions:
a. you must reside in, and provide a delivery address within the Republic of Albania;
b. you must be 18 years of age or older;
c. you must hold a valid debit or credit card issued in your name;
You are advised to read these Terms & Conditions every time you intend to make a purchase as the Terms & Conditions may change from time to time upon the Vodafone discretion. When you place an order with us you have accepted and agreed with these Terms & Conditions.
6. Vodafone eShop Service
We will provide you access to the features of the Service free of charge but you can incur in data charges and costs in accordance to the prices of your tariff plan in cases you are visiting the web through your mobile phone or using Vodafone Mobile Broadband.
Vodafone eShop Service is property of Vodafone You acknowledge that title and full ownership rights to the Service will remain the exclusive property of Vodafone and You will not attempt to copy, modify, alter the Service in anyway or sublicense or lease the Vodafone eShop Service.
The Service allows you to:
a. View the available devices which are being sold via Vodafone eShop. You may display the content sorting it by different choices, characteristics, categories or other features.
b. Compare devices among the available items, add and/or remove item up to 4 devices, while an analytical comparison based on key features table will be displayed. This in order for you to may easily make the difference between devices features.
c. Purchase the selected device/s. When the Vodafone customer presses “Add to basket” button in the selected item/s, the customer will be required to “Proceed with checkout process” and then asked to “sign in” using My Vodafone applications credentials or to “sign up”. After a successful sign in process the customer will be then redirected to the e-Commerce payment page. Vodafone will not collect any personal financial records entered by the customer during this process. Vodafone customers that do not prefer to get registered and other categories of customers will be able to perform the purchase activity as Guests. All guests will not be able to have profile history, while Vodafone will keep the guest’s order details as record. ...
d. Product/s are equipped with the necessary information for their use and have also incorporated the warranties provided by the producer. All product specifications and the full order description are listed in device details in the Vodafone eShop page.
7. Making a Purchase
a. When you opt to purchase devices will be required to provide certain personal and payment details, any information that you provide to us for the purpose of making a purchase must be fully complete and accurate. In particular you must ensure that you are legally and fully entitled to use any debit or credit card used for a purchase and that sufficient funds are available to cover any charges incurred by you. We will only accept payments by certain types of credit card. No cash or cheques will be accepted. Any credit cards that you use must be valid at the date of making your purchase. We will accept payment for devices according to the instructions given by you.
b. The prices for Devices are quoted in ALL. All prices are stated inclusive of valued added tax (VAT) at the relevant rate (currently 20%).
c. When you submit details to make a purchase, a credit card check is carried out by eCommerce Connect payment platform in cooperation with Raifeissen Bank (partner bank) which is partner of Vodafone in implementing Vodafone e-Shop. We will send you an email confirming receipt of your order; this email shall not constitute an acceptance of your order. Your order will not be accepted and an agreement concluded between us and you until the relevant product/s have been shipped to you. Your credit card will be charged with the price of the Product/s.
d. We order if the partner bank refuses to authorise your credit card for payment, if Products are out of stock or for any other legitimate reason. You will be advised if this occurs.
e. Accepting the Offer - We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation). The Contract between us will only be formed when we send you the Dispatch Confirmation.
f. Sudden Unavailability - If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because of an error in the price on our site as referred to in clause 7/h below, we will inform you of this (by e-mail) and we will not process your order. If you have already paid for the Product, we will refund you the full amount within 30 days from the order made by you.
g. Mistakes in Pricing- Our site contain a large number of Products. It is always possible that, despite our best efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. I
h. Once we give you online confirmation of your purchase your order cannot be cancelled at that stage. However, we do operate a return policy compliant with the Albanian legislation according to which the purchased product may be returned within 14 days from the delivery date. Further details of the returns policy are supplied on the online ordering page. If you are making a return you should comply with the Return Policy specifications, print the return form from the website, complete the form and send it to us with your return. Please note if returning Product/s we require the original invoice or your full name and address. Without this information we will be unable to identify a returned package as yours and we will not be able to process the return/refund.
i. You should note that delivery will be to the address as specified by you in the online order within the timeframes specified in the Delivery Information. Attached to the Product/s you will receive VAT invoice. You need to sign the courier form and VAT invoice provided by the courier. Deliveries will not be made to PO Boxes or to addresses outside the Republic of Albania. In the event of delay or non-delivery of products/services you should immediately contact our Customer Care Service via email at: email@example.com or by calling 140 in case you are a pre-paid customer or149 in case you are a post-paid customer who will assist you in resolving the matter.
j. You are responsible for the information you submit, therefore you shall provide valid personal information while performing a Purchase. We will dispatch your order in the address provided by you and we shall take no responsibility in case the order will be not received by you personally.
8. Delivery information
We will deliver your order free of charge as per following destinations’ timeframes:
- Tirana district - within 24 hours (working days)
- All over the rest of Albania districts – within 48 hours (working days)
For purposes of the above Article, working days shall be determined based on the provisions of the Albanian Labor Code.
9. The packaging results to be opened or damaged
If in the courier’s presence (during hand over process), you realize that the package is opened or damaged, you may immediately return the order back to the courier by filling the RA form which you may find it inside the package or you may print it directly from here Note that in case the packaging result to be opened or damaged, DON’T SIGN the courier voucher, but just properly complete the RA (Return Authorization) form and give it back to the courier order Not later than the hand over process (from courier to you)
10. Your Information
b. Vodafone may from time to time contact you by post, email, text message or telephone with information on new products, services, special discounts or other information we believe may be of interest to you. If you would prefer not to receive such information please tick the appropriate "opt out" options when submitting your order.
11. Intellectual Property Rights
Vodafone e-Shop solution is property of Vodafone Albania Sh.A. You cannot reproduce, copy, duplicate, sell, resell, rent or trade the Service (or any part thereof) for any purpose. By agreeing with these terms & conditions You do not receive any Intellectual Property Rights or other rights associated with it, including patents, designs, trademarks, and copyright in the content of Vodafone e-Shop. Vodafone e-Shop IPR’s are protected by the local law in the field of Intellectual Property Rights and the relevant international treaties.
12. Limitation of Liabilities
The / website (including the Vodafone e-Shop) are provided "as-is" and all conditions and warranties expressed or implied by the local legislation are excluded to the fullest extent permitted by law. Without prejudice to the generality of the foregoing, we make no warranties or representations that the operation of the site will be uninterrupted, timely, or error-free. Unless otherwise stated we shall not be liable for any losses, damages (other than for death or personal injury caused by our negligence), costs or expenses (including indirect or consequential loss (including loss of use, data, profits, business or anticipated savings) arising out of or in any way connected with your use of the site and whether based in contract, tort, or otherwise, even if we or any of our suppliers have been advised of the possibility of such losses, damage, costs or expenses. It is your responsibility to evaluate the information about Product/s provided on this web-site and to decide on the suitability of such Product/s for your needs.
13. No transfer of the Service
You may not rent, lease, license, loan or assign your rights to the Vodafone e-Shop to another person.
a. We may modify, suspend or discontinue the Vodafone e-Shop service at any time with or without notice to you and without liability to you. Discontinuation may occur for any valid technical, operational or commercial reason. We do not guarantee or warrant that any particular functionality, features, information or Product/s promoted on the web-site will be available to you at any given time. All Products are subject to availability and we reserve the right to change or vary the Product promoted on the Vodafone e-Shop the prices at any time.
b. You agree:
to comply with all of our reasonable requests or instructions in relation to the use of the Vodafone e-Shop services;
to comply with all requests or instructions of any authorised authority in relation to the use of the Vodafone e-Shop or the internet in general or for the investigation of any alleged offences;
to abide by all applicable laws and regulations (including copyright and intellectual property protection laws);
not to distribute, download, upload or transmit any material which contains viruses, Trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programmes;
not to attempt to gain unauthorised access to or interfere with this web-site, other users, computer systems or connected networks;
not to disguise the origin of any transmitted communication or impersonate any other person or entity;
to notify us immediately of any breach of security or any claim or legal proceedings against you relating to your use of the Vodafone e-Shop;
c. We may suspend or terminate your access to the site wholly or partially and with or without notice for any valid reason including, without limitation where you fail to observe or perform any obligation set out in the terms & conditions any relevant law, licence, regulation, directive, code of practice or applicable usage policy; or you fail to pay us any sums due to us; or you supply us with false, misleading or inaccurate information at any time; or we suspend or discontinues the web-site.
d. Where we exercise any of our rights or powers under Article 12 paragraph c) such exercise shall not prejudice or affect the exercise of any other right, power or remedy which may be available to us. We shall not be liable to you or any third party for any suspension or termination of your access to or use of the web-site.
e. These terms & conditions are prepared in Albanian and English language, are governed by the laws of Albania and we and you submit to the exclusive jurisdiction of Courts of Albania. If any part of these terms & conditions is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms & conditions shall remain in effect.

During Bazaar Event December 11th, 2014 until January 12th, 2015 the following Terms & Conditions will be associated to VF eShop:
a.Vodafone Albania eShop will offer a limited stock from Vodafone Bazaar 2014 items only
b.Guests cannot buy in Vodafone eShop Bazaar 2014
c.Customers are eligible to ONLY ONE ITEM purchase during Bazaar 2014
d.Customers that perform successful purchase will benefit:
- Data bundle of 500MB valid for 30 days from item purchased
- Will be rewarded with 500 MB per month for three months in a row (valid for 30 days)
e.Vodafone Bazaar offer is subject to stock availability and valid for the period from 11.12.2014 up to 12.01.2015.
In which case I can return my order?
An order can be returned in case:
The item received is not the one that have ordered
The packaging results damaged or/and opened
*Return must be done within 14(fourteen) days from the hand over/delivery date (from courier to the customer)
How can I return an item?
You can return your items within 14(fourteen) days from the moment you have received your order. You just need to send back the whole order (exactly as received by you), including the VAT invoice, print from here and fill up the RA (Return Authorisation). You must return your order at the nearest Vodafone shop

In how much time will I receive back my order?
You will have back your order within 24 (twenty four) working days. In case of no availability of that item, we will fully refund you within 30 days from the moment we receive your RA.
Refund Method/ How will I be refunded?
The refund will be made in the same way as the initial payment. Your bank account will be credited again within the timeline specified above.
